Homebuyers of Mahagun Mantra, a housing project in Greater Noida, are planning to take legal action against the developer for repeatedly missing the deadline of the project.

Over 1,000 homebuyers of the project have been waiting for the delivery since December 2017.

“We have had numerous discussion with the builder but every time he gives us new date for delivery. We were planning protests but due to the rising cases of COVID, postponed it. We will now approach the relevant authority for action against the builder,” said KK Arora, a homebuyer.

The homebuyers had recently approached the Greater Noida Authority and the authority informed that builder has not cleared the dues and that is why they are not getting the completion certificate.

“The builder now say that the project is getting delayed due to COVID. However, the first completion date was December 2017. Majority of the buyers are from middle class family and for 10 years, we are paying both emi and rent,” said Purnendu Shekhar, another homebuyer.

Mahagun did not respond to the query.

There are over 1700 flats in the project, which is being developed in two phases.

The National Real Estate Development Council (NAREDCO) for Uttar Pradesh has written to the Real Estate Regulatory Authority (RERA) of the state asking for a six months automatic extension for compliance of various orders issued by the authority after construction activities at all real estate projects have come to a complete standstill with the escalation of second wave of Covid-19 cases.

According to data by the Ministry of Housing and Urban Affairs, 65,539 cases have been disposed of by the respective state RERA authorities as of 24 April 2021.

Out of this, nearly 40% cases (26,510 complaints) were resolved in Uttar Pradesh alone.

NAREDCO-UP has also requested state RERA a extension of similar time period for completion of various projects of developers registered with UP-RERA and submission of various returns and documents.
